Man- Ann Brown. Darlene Theresa "I don't plan a recession or weakening of those positions discussed with Johnson and the governor." the Vermont attorney general said. "If they (IPC and New York) decide to agree to our position, we. of course, would be delighted." Vermont brought the U.S. Supreme Court suit against the paper company and New York to force the removal of a 300-acre sludge bed from the bottom of Lake Champlain.

Vermont claims the sludge resulted from waste deposits from an old IPC mill in Ticonderoga, Y. The state also is seeking damages and claims a new IPC mill is degrading the lake. According to reliable reports, the key issue that remains unresolved involves the degree of pollution from the paper company's new mill, near Ticonderoga. Johnson is said to be committed to the view that IPC must pay stiff fines until the level of suspended solid discharge is at an acceptable level. Johnson is said to be insisting that the new mill not be permitted to discharge more than 30 milligrams of suspended solids per liter.

The mill is now discharging close to 100 milligrams per liter. When asked whether Johnson's reported concern was a key remaining issue, Cheney said several factors including biological oxygen demand, suspended solids, nitrogen levels and the toxicity of the water are all of concern to the state. "No one is critical." he added, "they all have to be brought into reasonable levels." Cheney said Johnson, the governor and the representatives from the attorney general's office all agree on Vermont's out-of-court position in the case. THESE ARE some of Brunell. David Leo Brunell.

"It's far from being settled out of court," he said, when contacted at his home in Marshfield. "'Vermont intends to proceed with the suit." The reason the court hearings will resume.

"It's a definite decision to go ahead i with the court proceedings! if the company doesn't agree to meet the conditions that we laid out to them." iThose conditions will be negotiated out of court this week.

Cheney said he. Gov. Salmon. Johnson and Asst. Attys.

Gen. John Hansen. John Calhoun and Martin Miller worked on Vermont's out-of-court negotiating position over the weekend. He added, "Without going into specifics, we still feel the company ought to do better in the area of air (quality i in the new mill." Chenev said parties to the litigation had "narrowed their differences" during out-of-court negotiations in Boston last week. But.

he added, although there was considerable agreement on issues relating to air and water pollution from the new mill and sludge deposits from the old mill, there are still "two or three unresolved items Vermont feels are critical." He declined to specify those items. Nonetheless. Cheney said he had been in contact with the New York lawyers since he discussed Vermont's position with Johnson. And. he added, there is some reason to believe that remaining issues could be resolved this week in Boston.

"I can't say they've definitely slammed the door" on Vermont's position. Cheney said. Miller and Calhoun returned to Boston Sunday night for a week of negotiations which begin this morning, Cheney said. He added he is "cautiously optimistic" that the negotiations may be successful and the formal court proceedings could be averted.
